Welcome to Adaptiv Training. These Terms of Service ("Terms") govern your access to and use of the Adaptiv Training web application, native iOS application, and related services (collectively, the "Service"). By creating an account or using the Service in any form, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
Adaptiv Training is a closed-loop training platform for endurance athletes, available as a web application and a native iOS app. The Service combines objective biometric and workout data with subjective daily readiness inputs to dynamically generate and adapt personalized training load recommendations. The Service can receive data from Apple Health (including data from devices such as Garmin watches that sync to Apple Health), Wahoo, WHOOP, COROS, Oura, Polar, and Suunto. Subscriptions purchased in the iOS app are billed through Apple; subscriptions purchased on the web are billed through Stripe.
You must be at least 13 years of age to use the Service. If you are under 18, you must have the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.
To use the Service, you must create an account, either with an email address and password or with Sign in with Apple, and provide certain personal and physiological information. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
Certain features of the Service require a paid subscription. Which company bills you depends on where you subscribe. Subscriptions purchased in the iOS app are sold and billed by Apple. Subscriptions purchased on our website are billed by Stripe on our behalf. These are separate billing systems: a subscription purchased through one cannot be managed, cancelled, or refunded through the other.
Payment is charged to your Apple Account at confirmation of purchase. Your subscription automatically renews for the same period unless it is cancelled at least 24 hours before the end of the current period, and your Apple Account will be charged for renewal within the 24 hours before the current period ends.
You can manage or cancel an iOS subscription only in your Apple Account settings (on your device: Settings → [your name] → Subscriptions). You cannot cancel an Apple subscription from within Adaptiv Training, and deleting the app or your Adaptiv Training account does not cancel it. Refunds for App Store purchases are handled by Apple under its policies; we are unable to issue refunds for purchases made through Apple.
Web subscriptions are processed by Stripe. By subscribing on the web, you authorize Stripe to charge your selected payment method on a recurring basis until you cancel. You may cancel a web subscription at any time through your Adaptiv Training account settings. Cancellation takes effect at the end of your current billing period, and you keep access to paid features until then. We do not provide prorated refunds for partial billing periods.
Eligible new accounts receive a 30-day free trial. The trial is provided directly by Adaptiv Training; it is not an App Store introductory offer and is not billed by Apple or Stripe, so you will not be charged when it ends. When the trial ends without a subscription, access to paid features ends.
If you purchase a subscription during your trial, the unused trial days are credited forward: your paid access is extended by the number of trial days remaining, so you do not lose any of your trial.
We may change subscription pricing. For web subscriptions, we will give you at least 30 days' notice by email before a new price takes effect. For iOS subscriptions, price changes are communicated and applied by Apple under its rules, which may require your consent before an increase applies. Your continued subscription after a price change takes effect constitutes acceptance of the new price.
You agree not to use the Service to:
Connecting a third-party account authorizes us to receive data from that service as described in our Privacy Policy. For every integration below, disconnecting it in Adaptiv Training settings permanently deletes the data we received from that service; workouts you logged manually are not affected. We are not responsible for any third party's availability, data accuracy, or changes to its API or terms.
The Adaptiv Training iOS app requests access to Apple HealthKit data. If you authorize this access, the app uses HealthKit background delivery to receive health and workout data, including data from other devices that sync to Apple Health such as Garmin watches, without requiring you to open the app. You may revoke HealthKit access at any time in iOS Settings (Privacy & Security → Health → Adaptiv Training). We are not responsible for the accuracy of data provided by Apple Health or connected device sensors.
If you connect your Wahoo account, you authorize us to access your workout data via the Wahoo Cloud API.
If you connect your WHOOP account, you authorize us to access your recovery, sleep, workout, and body measurement data via the WHOOP API using the read:recovery, read:sleep, read:workout, and read:body_measurement scopes.
If you connect your COROS account, you authorize us to access your workout data via the COROS API.
If you connect your Oura account, you authorize us to access your recovery and sleep data via the Oura API.
If you connect your Polar account, you authorize us to access your workout data via the Polar AccessLink API.
If you connect your Suunto account, you authorize Suunto to send your completed workouts to us automatically. Suunto delivers this data to our servers as workouts are completed, without requiring you to open the app.
iOS purchases are processed by Apple and are subject to Apple's terms and the App Store Usage Rules. Web purchases are processed by Stripe and are subject to Stripe's terms of service and privacy policy. We do not receive or store your payment credentials.
The Service, including its software, algorithms, design, text, graphics, and other content, is owned by Adaptiv Training and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial training purposes, subject to these Terms. For the iOS app, this license is further limited as described in Section 13.
You retain ownership of any data you submit to the Service (workout logs, check-in data, race results, etc.). By submitting data, you grant us a limited license to use that data solely to provide and improve the Service for you.
The Service is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
The training recommendations provided by the Service are generated by algorithms based on the data you provide and should not be considered medical advice.
You should consult with a qualified healthcare professional before beginning any new exercise program or if you have any concerns about your health. You assume full responsibility for any risks associated with your use of the Service and your training activities. If you experience any pain, discomfort, or adverse symptoms during exercise, stop immediately and seek medical attention.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected.
We do not guarantee the accuracy, completeness, or reliability of any training recommendations, recovery scores, or fitness metrics generated by the Service.
To the maximum extent permitted by applicable law, Adaptiv Training and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising out of your access to or use of (or inability to access or use) the Service.
In no event shall our total liability to you for all claims arising out of or relating to these Terms or the Service exceed the amount you have paid us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless Adaptiv Training and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of another party.
This section applies to your use of the Adaptiv Training app downloaded from the Apple App Store. If anything in this section conflicts with the rest of these Terms, this section controls with respect to the iOS app.
These Terms are concluded between you and Adaptiv Training only, and not with Apple Inc. ("Apple"). Adaptiv Training, not Apple, is solely responsible for the app and its content.
The license granted to you for the iOS app is a non-transferable license to use the app on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that the app may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.
Adaptiv Training is solely responsible for providing any maintenance and support services for the app. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the app.
Adaptiv Training is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Adaptiv Training's sole responsibility.
Adaptiv Training, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement, including any claim relating to health, fitness, or training information provided by the app; and (iii) claims arising under consumer protection, privacy, or similar legislation, including in connection with the app's use of the HealthKit framework.
In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, Adaptiv Training, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You must comply with applicable third-party terms of agreement when using the app, for example your wireless data service agreement.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we reasonably believe you have violated these Terms. You may delete your account at any time in the app under Settings → Account → Delete Account, or by contacting us. Upon termination, your right to use the Service will immediately cease, and we will delete your data in accordance with our Privacy Policy. Deleting your account does not cancel a subscription purchased through Apple; cancel it in your Apple Account settings as described in Section 5.1.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice within the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Fort Collins, Colorado. You agree to waive any right to a jury trial or to participate in a class action.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Adaptiv Training regarding your use of the Service and supersede all prior agreements and understandings.
